Editxpress Service Agreement

Indemnification
The customer agrees to indemnify editxpress and all persons acting as agents of editxpress, against liabilities for any direct, indirect, incidental, special or consequential damages that may be construed as originating from use of the service. The customer assumes agency in this capacity, and for any party that they represent. In the case of dispute over services, charges, timing or treatment by editxpress, the sole and exclusive remedy of the customer (and the interests represented by them) is to discontinue the service.

Privacy
Unless editxpress is ordered at a point of law, all communication shall remain confidential, unless agreed to in writing (including email).

Termination of Service
editxpress reserves the right to refuse or discontinue the service at any time without notice, and at the sole discretion of editxpress. In the event of refusal of service, the disclaimers and limitations of liabilities set forth in this agreement, shall survive.

Warranties
The provision of the editxpress site, communications and services are without warranties of any kind, either express or implied. No part of any correspondence with editxpress shall be deemed a warranty. The customer is solely responsible to evaluate any correspondence, service or information provided by editxpress.

Payment and Level of Service
The receipt of credit card details by editxpress is seen as the authorization of the customer, including any third party they may represent, to use such details for the purposes of crediting editxpress. Consequent services provided by editxpress will be delivered to the acceptable level deemed by editxpress.

In the event of the "xpress service", where editxpress guarantees a 36 hour turn around, the charge and quality of service are understood to be at the sole discretion of editxpress or any of its agents.

The "quoted" service means editxpress will conduct business in agreement to the terms set out with the "quote" set out on the "rates" and "faqs" links on the site. Interpretations of the terms set out with the "quote" are established and maintained by editxpress.

The customer waives any right to dispute or act against editxpress or the decisions made by editxpress or its agents in relation to the charge or quality of service.

Work is not considered finished and will not be returned until payment is made.

Security
In the event of the use of personal details, including credit card details, beyond those agreed to in writing with the customer and editxpress, the customer waives any right to take any action against editxpress, regardless of cause - by hacking, negligence on behalf of editxpress or any other means.

Limitation of Liabililty
The customer agrees that the highest amount of damages that may be claimed, and only at the discretion of editxpress, is that of the singular transaction in dispute. It is the responsibility of the customer in this circumstance to advise editxpress in writing within seven days of the receipt of documents attended to by editxpress. Beyond this period, the customer waives any right to negotiation or grievance. Further, editxpress offers no guarantee as to the success of documents after the service has been applied. This term of service, supported by the other terms of this agreement, forms the limit of damages agreed to by the customer and editxpress.

Prior Agreements
This agreement supercedes any communication that editxpress conducts with the customer. Should any part of this agreement not be enforceable, it will not exclude any other term of the agreement.

User Identification
It is the responsibility of the customer to ensure that all information presented to editxpress, including personal details, be true and current. Authorization to use credit cards is the responsibility of the customer. The content of documents does not contravene any law, and the customer assumes full responsibility for any action resulting from work submitted.

Miscellaneous
editxpress reserves the right to change the terms and conditions of this agreement at any time without notice. editxpress also reserves the right to change rates at any time. editxpress will not be held responsible for the content of a work beyond the grammatical, stylistic and basic tenets of good writing. By providing editxpress with any form of documents or information, the customer declares that he/she is authorized to use any and all information provided for the purposes of service or payment of service. Further, editxpress and its agents cannot be held liable for any damage to, or loss of information. editxpress does not guarantee, nor warrant the reliability of the servers, nor the data recovery of customer's materials.

Acknowledgement
The provision of service by editxpress is an acknowledgement that the customer has read, understood and agreed to the terms set out on this page. The provision of service by editxpress is to be understood as a declaration by the customer that editxpress has been clear and accessible in providing the terms of this agreement.

All transactions and correspondence are bound to this service agreement.
